I – DOMAINE D’APPLICATION

Les conditions générales s’appliquent aux contrats ayant trait à un séjour organisé par LABEL INSPI x MINDFUL MOMENTS, ainsi qu’à toutes les autres prestations fournies aux participants sur le lieu du séjour. Ces conditions prévalent sur tout autre document.

II – OBJET DU CONTRAT

Pour réserver un séjour organisé par LABEL INSPI x MINDFUL MOMENTS, les clauses ci-dessous trouvent application :

A- La proposition

Les informations données sur les différentes prestations proposées, aux transports, aux séjours, aux conditions de paiement et conditions d’annulation, constituent l’offre préalable au sens de l’article L.211-8 du code du Tourisme. Toutes les prestations proposées lors de la conclusion du contrat seront celles convenues entre les parties. Avant la signature du contrat, l’offre initiale peut être modifiée en respectant l’information du participant par tout moyen, afin que ce dernier s’engage en toutes connaissances sur les prestations qui seront réalisées. Pour toutes les activités, chaque participant doit s’assurer, avant toute signature du contrat, auprès de son Médecin, de son aptitude physique à suivre les activités proposées, de sorte que la responsabilité de LABEL INSPI x MINDFUL MOMENTS  ainsi que celle de ses partenaires, notamment son professeur de yoga, ne puisse être engagée en cas d’incident ou d’accident.

B- Les modalités de réservation

Il est précisé que l’application de l’article L.121-21 et suivant du Code de la Consommation portant sur le droit de rétractation ne trouve pas application en matière de ventes touristiques. 

Le règlement du séjour s’effectuera par paiement en ligne sécurisé sur le site de labelinspi.com

La remise des documents de voyage et toute information relative au séjour réservé s’effectuant par courrier électronique, le client devra communiquer, lors de son inscription, une adresse électronique valable et consulter régulièrement sa boîte mail.

IMPORTANT – 

Si le nombre de participants minimum est atteint au jour de l’inscription et de la réception du paiement, un mail de confirmation définitive est adressé au participant, lequel pourra ensuite réserver son moyen de transport. 

Si le nombre minimal de participants n’est pas atteint lors de la réception de l’inscription et du règlement, un mail de confirmation d’option sera adressé sous réserve du seuil minimal de participants.

Si 90 jours avant la date du séjour, le nombre minimal n’est pas atteint, nous envoyons un mail d’annulation du séjour et procéderons au remboursement des inscrits.

Si le nombre de participants est inférieur au nombre minimum requis, LABEL INSPI x MINDFUL MOMENTS  pourra alors proposer au client de maintenir le voyage en contrepartie d’une majoration « petit groupe » du prix initial. Le surcoût éventuel de cette formule « petit groupe » sera communiqué à l’utilisateur qui pourra l’accepter ou le refuser. 

-En cas d’acceptation, ce surcoût fera l’objet d’une facturation complémentaire. Ce supplément sera remboursé si d’autres participants venaient à s’inscrire pour le voyage avant la date de départ et que le nombre initial de voyageurs minimum requis était atteint. 

-En cas de refus du surcoût proposé, la réservation de l’Utilisateur sera annulée sans frais et le montant versé lui sera alors intégralement remboursé.

C- Le prix et modalités de paiement

Ne sont pas compris dans le prix : le transport et tous les frais liés à ce dernier, et les assurances tant responsabilité civile que assurance annulation.

Le descriptif de chaque séjour mentionne les prestations incluses et non-incluses ainsi que les montants des suppléments s’il y a lieu pour chambre individuelle, prestations de catégorie supérieure ou petits groupes.

Tout séjour commencé est dû dans sa totalité.

Tous nos tarifs sont TTC.

Le non-paiement du prix du voyage à l’échéance autorisera LABEL INSPI x MINDFUL MOMENTS  à considérer le voyage comme annulé du fait du client au jour du départ et en conséquence à facturer à ce dernier l’intégralité des frais d’annulation normalement dus à cette date, soit 100% des frais.

III – MODIFICATION DE L’OFFRE

A- A l’initiative de LABEL INSPI x MINDFUL MOMENTS 

Toute modification apportée par LABEL INSPI x MINDFUL MOMENTS  et ne touchant pas à un élément essentiel du séjour (ex : dates, hébergement, fournisseur des repas, professeurs, etc) ne pourra en aucun cas justifier une quelconque demande d’indemnisation ou une quelconque demande d’annulation de la part du Participant.

Toutes modifications du séjour dont LABEL INSPI x MINDFUL MOMENTS  est à l’origine et entraînant un surcoût sera soumis pour acceptation préalable au Client.

Le séjour sera remboursé en cas de refus du participant de prendre en charge le coût supplémentaire.

En cas d’acceptation de ce dernier, il s’engage à virer sur le compte de LABEL INSPI x MINDFUL MOMENTS  le montant du surcoût pour confirmer son accord et recevra par retour un mail de confirmation de sa participation au séjour.

B- A l’initiative du Participant

Toutes modifications des conditions de réservation (chambre individuelle, activités…) est soumise à l’accord préalable de LABEL INSPI x MINDFUL MOMENTS  et ne pourra générer de remboursement pour quelque cause que ce soit. Si les demandes de modification peuvent être acceptées par LABEL INSPI x MINDFUL MOMENTS  et génèrent un coût supplémentaire, le participant s’engage à virer dès réception de la nouvelle facture, les frais supplémentaires. 

Toutes activités ou engagements non consommés pendant le séjour du fait du Client ne donneront lieu à aucun remboursement.

Tout séjour écourté pour quelque raison que ce soit ne donnera lieu à aucun remboursement.

Chaque modification du fait du Client ouvrira droit à la perception par LABEL INSPI x MINDFUL MOMENTS  de frais de dossier fixés à 15€.

IV – ANNULATION – RÉSILIATION

A- En cas d’annulation du séjour par le participant :

Toute demande d’annulation et de remboursement devra être faite par mail à l’adresse suivante : hello@labelinspi.com

Cette annulation ouvrira droit à la perception par LABEL INSPI x MINDFUL MOMENTS  à un dédommagement, lequel est fixé :

– A plus de 90 jours avant le départ, seront retenus 30% du montant total TTC + 25€ frais de dossier 

– A moins de 90 jours avant le départ, seront retenus 50% du montant total TTC+ 25€ frais de dossier 

– A moins de 30 jours avant le départ, seront retenu 100 % du montant total TTC + 25€ frais de dossier 

Si le participant ne se présente pas au stage ou si le participant quitte le stage avant la fin prévue le solde final reste dû et aucun remboursement ne sera possible quel que soit le motif invoqué.

B- En cas d’annulation du séjour par LABEL INSPI x MINDFUL MOMENTS  :

En cas d’annulation du séjour par LABEL INSPI x MINDFUL MOMENTS , tous les versements seront intégralement remboursés mais aucune indemnisation ne pourra être demandée à quelque titre que ce soit. Tous les frais engagés par le Participant n’ouvriront droit à aucun remboursement.

Infos liées au COVID-19 ou à une quelconque pandémie 

1. Dans un contexte COVID-19, si les mises en place par le gouvernement ne nous permettent pas de voyager car confinement, le séjour sera annulé et reporté à une date ultérieure. De ce fait, nous rembourserons le séjour.
2. Nous invitons nos participants à être le plus responsable possible. Si des symptômes apparaissent avant le départ, nous vous prions de vous faire tester et de nous informer de la situation.
3. Dans le cas d’un test positif chez le participant avant le séjour, il conviendra d’une annulation tardive. N’étant pas un cas de force majeure (article 1218 du Code Civil), le participant ne pourra prétendre à un remboursement ou quelconque dédommagement.

Au moment de votre inscription pour un séjour, LABEL INSPI x MINDFUL MOMENTS  vous propose les offres d’assurances de son partenaire. Il est fortement recommandé d’y souscrire.

V – DOCUMENTS

Une carte d’identité/un passeport pourra être demandé(e) pour toute première participation à un séjour organisé par LABEL INSPI x MINDFUL MOMENTS . Le Participant veillera à avoir des documents d’identités en cours de validité au moment du Séjour et qui correspondent à son titre de transport et tout document lié à la situation sanitaire (Test négatif, attestation spécifique).

Le non-respect par le voyageur des obligations administratives et/ou sanitaires de franchissement des frontières qui aurait pour conséquence notamment un refus d’embarquement ou une interruption du séjour ou du voyage, ne pourra justifier un quelconque remboursement ou dédommagement.

VI – RESPONSABILITÉ POUR LES OBJETS APPORTÉS

LABEL INSPI x MINDFUL MOMENTS  décline toute responsabilité en cas de perte ou de vol de vos effets personnels, en particulier dans le cas de bijoux, documents ou argent liquide et toute responsabilité pour des dommages résultant directement ou indirectement de l’utilisation des infrastructures du lieu accueillant la retraite.

VI – ASSURANCES

Aucune assurance n’est comprise dans le prix du séjour. Il est fortement recommandé et il appartient au Participant de souscrire, à ses frais, à toute assurance ou assistance rapatriement. À la suite de votre inscription, les offres de notre partenaire d’assurance vous seront proposées. 

En cas d’annulation du voyage ou du séjour par le Participant, la prime d’assurance n’est jamais remboursable et la souscription à une assurance n’est en aucun cas remboursable.

Toute déclaration de sinistre doit se faire directement auprès de la compagnie d’assurance par le Participant, en respectant les termes du contrat d’assurance souscrit.

VII – CONTESTATIONS – LITIGE

Le présent acte est soumis au droit français. Toute réclamation concernant les conditions de séjour doit être faite sans délai, sur place et par écrit, auprès des organisateurs du séjour et auprès de LABEL INSPI x MINDFUL MOMENTS  à l’adresse email suivante : hello@labelinspi.com. Une réponse vous sera apportée dans les meilleurs délais.

A défaut d’accord amiable préalable à toute action et à défaut de réponse satisfaisante sous deux mois à réception du mail, le Participant pourra saisir la Juridiction compétente du ressort du Siège de l’Association fixé dans le Lot et Garonne.

VIII – FORCE MAJEURE

Les partis seront exonérés de leurs obligations dans le cas d’une circonstance constitutive d’un cas de force majeure, tel que défini par l’article 1218 du Code civil, qui empêcherait leur exécution. Les obligations des partis seront alors suspendues de plein droit sans indemnité à compter de la date de survenance de l’événement. Le parti qui invoque une telle circonstance devra en avertir l’autre parti immédiatement par tous moyens, notamment par téléphone et courrier électronique.

Sont considérés comme des cas de force majeure tous faits ou circonstances irrésistibles et imprévisibles, inévitables et qui ne pourront être empêchés par ces dernières, malgré tous les efforts raisonnablement possibles, définis comme tel par la jurisprudence française et notamment, le blocage des moyens de transports, d’approvisionnements, tremblements de terre, incendies, tempêtes, inondations, foudre, épidémies, guerres, et l’arrêt des réseaux de télécommunication.

Si la Prestation ne pouvait pas être effectuée ou continuée par LABEL INSPI x MINDFUL MOMENTS , le contrat serait résolu et le Participant ne pourrait alors prétendre à un quelconque dédommagement ou à une quelconque indemnité de la part de LABEL INSPI x MINDFUL MOMENTS , qui reversera cependant toute somme non-dépensée et qu’elle détiendrait encore, ou dont elle aurait obtenu le remboursement au nom et pour le compte du Participant.

IX – ACCEPTATION DES CONDITIONS GÉNÉRALES DE VENTE

Je déclare être en bonne condition physique et apte à la pratique du yoga. Par conséquent, je dégage le professeur de yoga  de toutes responsabilités en cas de blessures, invalidité, maladies, décès, perte de revenus et autres pertes ou dommages à mes biens personnels dont je pourrais être victime. 

Je certifie également être titulaire d’une responsabilité civile personnelle.

GENERAL TERMS AND CONDITIONS OF SALE

I – FIELD OF APPLICATION

The general terms and conditions of sale apply to contracts relating to a SAS LABEL INSPI x MINDFUL MOMENTS stay, as well as to all other services provided to participants during the stay. These terms and conditions prevail over any other document.

II – SUBJECT OF THIS CONTRACT

When booking a SAS LABEL INSPI x MINDFUL MOMENTSÉ stay, the clauses below apply :

A- The offer

The given information on the various services offered, transport, stays, payment conditions, and cancellation policies, constitute the preliminary offer within the meaning of article L.211-8 of the Code du Tourisme. All the services offered at the time of the conclusion of the contract, shall be those agreed between the different parties. Before the contract is signed, the seller reserves itself the right to modify the offer while respecting by all means the information provided to the Participant, so that the latter may commit himself in full knowledge of the services that will be rendered.

For all activities, each participant must ensure, before signing the contract, with his or her doctor, that he or she is physically fit and able to take part in the offered activities, so that the responsibility of the SAS LABEL INSPI x MINDFUL MOMENTS as well as that of its partners cannot be engaged in the event of an incident or accident during the stay.

B- Terms and conditions of booking

It is specified that the application of article L.121-21 and following of the Code de la Consommation (Consumer Code) concerning the right of withdrawal, does not apply to tourist sales.

Payment for the stay will be made directly via our online site. Payment is secure. The registration for the stay will be final only after receipt of payment and confirmation by email from LABEL INSPI x MINDFUL MOMENTS.

The delivery of the travel documents and all information relating to the booking and stay being carried out by email, the customer must communicate, at the time of his registration, a valid e-mail address and consult his mailbox regularly..

IMPORTANT – 

If the required minimum number of participants is reached on the day of registration and receipt of payment, a final confirmation email will be sent to the Participant, who will then be able to book his or her transport.

If the required minimum number of participants is not reached on the day of registration and receipt of payment, a preliminary confirmation email will be sent, subject to reaching the minimum number of participants.

If 90 days before the date of departure, the required minimum number of participants is not reached, a cancellation email will be sent and we will proceed to the reimbursements of the registered participants.

If the number of participants is inferior to the required minimum number of participants, the LABEL INSPI x MINDFUL may offer to maintain the trip in exchange for a “small group” increase in the initial price. The possible extra cost of this “small group’ price increase will be communicated to the user who may accept or refuse it.

– If the User accepts, the extra cost will result in a complementary invoice. The additional costs will be refunded if other participants register for the trip before the departure date and the initial required minimum number of participants if reached. 

– If the User refuses, the reservation will be canceled without charge and the amount paid will be refunded in full.

C- The price and terms of payment 

The following are not included in the price : transport and all related costs, tourist taxes, and insurance, both civil liability and cancellation insurance.

The program description of each stay details the services included and not included in the contract, as well as the amounts of optional services such as a single room, higher category services or ‘small groups’ price increases.

Any stay started is due in full..

All our prices include VAT.

Failure to pay the price of the trip by the due date will entitle SAS LABEL INSPI x MINDFUL MOMENTS to consider the trip as canceled by the User on the day of departure and in consequence, to charge the client the full cancellation fee, as stated below, i.e. 100% of the price.

III – MODIFICATION OF THE OFFER

A- By LABEL INSPI x MINDFUL MOMENTS

Any modification made by LABEL INSPI x MINDFUL MOMENTS that does not affect an essential element of the holiday (e.g. dates, accommodation, meal supplier, teachers, etc.) shall not in any way justify any claim for compensation or any request for cancellation by the User.

Any changes to the stay for which LABEL INSPI x MINDFUL MOMENTS ~ Savage is responsible and which results in additional costs will be submitted to the Client for prior acceptance.

The stay will be reimbursed if the Participant declines to pay the additional cost.

If the Client accepts the additional costs, he or she will transfer the priorly communicated amount to the account of LABEL INSPI x MINDFUL MOMENTS to confirm their agreement. Upon receipt of the payment the client will receive a confirmation email.

B- By the participant

Any changes to the booking conditions (single room, activities, etc.) are subject to prior agreement by LABEL INSPI x MINDFUL MOMENTS, and cannot generate any refund for any reason whatsoever. If requests for modification can be accepted by LABEL INSPI x MINDFUL MOMENTS and generate an additional cost, the Participant will transfer the additional costs upon receipts of the new invoice.

Any activities or commitments described in the contract and not consumed due to the Client’s fault during the stay will not result in any refund for any reason whatsoever.

If a stay is cut short for any reason whatsoever, this will not give rise to any refund.

Each modification made by the Client will entitle the LABEL INSPI x MINDFUL MOMENTS to charge a handling fee of 15€.

IV – CANCELLATION – TERMINATION

A- In case the stay is canceled by the participant :

Any request for cancellation must be made by email to the following address : hello@labelinspi.com. The reply to this request will be considered as proof. This cancellation will entitle the LABEL INSPI x MINDFUL MOMENTS to a compensation, which is fixed :

– More than 90 days before departure, 30 % of the total amount including tax + a 25 € administration fee will be retained

– Less than 90 days before departure, 50% of the total amount will be retained + a 25 € administration fee.

– Less than 30 days before departure, 100% of the total amount will be retained + a 25 € administration fee.

If the participant does not show up for the internship or if the participant leaves the internship before the scheduled end, the final balance remains due and no refund will be possible for any reason.

B- In case the stay is canceled by LABEL INSPI x MINDFUL MOMENTS :

In the event that LABEL INSPI x MINDFUL MOMENTS cancels the stay, all payments will be refunded in full but no compensation may be claimed for any reason whatsoever. Any expenses incurred by the Participant will not be refunded.

Additional information linked to the COVID-19 or any other pandemic. 

1. In the context of COVID-19, if the government measures do not allow us to travel due to a lockdown, the trip will be postponed to a later date. 
2. We encourage our participants to be as responsible as possible. If any symptoms appear before departure, please get tested and inform us of the situation.
3. In the event of a positive test before the trip, a late cancellation will be in order. As this is not a case of ‘force majeure’ (article 1218 of the Code Civil), the Participant will not be entitled to any reimbursement or compensation.

When you register for a stay, LABEL INSPI x MINDFUL MOMENTS offers you the insurance policy of its partners. It is strongly recommended to subscribe to insurance.

V – DOCUMENTS

An identity card/passport will be required for any first participation in a stay organised by LABEL INSPI x MINDFUL MOMENTS. The Participant will ensure that he or she has valid identity documents at the time of the stay and they correspond to their transport ticket and any document related to the sanitary situation (negative test, specific certificate) and health/fitness certificate.

Failure by the Participant to comply with administrative and/or health requirements for crossing borders, which would result in a refusal to board or an interruption of the stay, shall not justify any reimbursement or compensation by LABEL INSPI x MINDFUL MOMENTS.

VI – LIABILITY FOR PERSONAL ITEMS

The LABEL INSPI x MINDFUL MOMENTS declines all responsibility for the loss or theft of personal belongings, and all responsibility for damage resulting directly or indirectly from the use of the facilities of the retreat venue.

VI – INSURANCE

No insurance is included in the price of the trip. It is strongly recommended. It is the responsibility of the Participant to subscribe to an insurance and/or repatriation insurance at his or her own expense.

In the event of a cancellation of the trip by the Participant, the insurance premium is non refundable and the subscription to an insurance policy is not refundable under any circumstances.

Any claim must be made directly to the insurance company by the Participant, in accordance with the terms and conditions stated in the contract of the selected insurance.

VII – DISPUTES – LITIGATION

This contract is subject to French law. Any complaint concerning the conditions of the stay must be made without delay, on the spot and in writing, to the organisers of the stay and to the LABEL INSPI x MINDFUL MOMENTS at the following address : hello@labelinspi.com. The User will receive a reply as soon as possible.

In the absence of an amicable agreement prior to any action and in the absence of a satisfactory response within two months of receipt of the email, the Participant may refer the matter to the competent court within the jurisdiction of the Association’s Head Office in the Lot-et-Garonne.

VIII – FORCE MAJEURE

The parties will be exonerated from their obligations in the event of a circumstance constituting a case of force majeure, as defined by article 1218 of the Code Civil, which would prevent their execution. The obligations of the parties will then be suspended by operation of law without compensation as from the date of the occurrence of the event. The party invoking such a circumstance shall immediately notify the other party by any means, by telephone and email.

Are considered cases of force majeure all irresistible and unforeseeable facts or circumstances, unavoidable and which could not be prevented by the latter, despite all reasonably possible efforts, defined as such by French jurisprudence and notably, the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning, epidemics, wars, and the breakdown of telecommunications networks.

If the stay cannot be performed or continued by LABEL INSPI x MINDFUL MOMENTS, the contract shall be terminated and the Participant shall not be entitled to any compensation or indemnity from LABEL INSPI x MINDFUL MOMENTS, who shall, however, repay any unspent sums that it may still be holding or for which it may have obtained reimbursement in the name and on behalf of the Participant.

IX – AGREEMENT TO THE GENERAL TERMS AND CONDITIONS OF SALE

I declare that I am in good physical condition and fit for yoga. Therefore, I release the yoga teacher from any and all liability in the event of injury, disability, illness, death, loss of income and other loss or damage to my personal property that I may suffer. 

I also certify that I hold personal civil liability.
